Terms of service
I. General Provisions
The Online Store is available at the following web address: www.latienebags.com (hereinafter: the “Online Store”).
The owner of the Online Store is Dariusz Winiarski, conducting business under the name LA TIENE BAGS DARIUSZ WINIARSKI, with its registered office at ul. Ułanów 11, 95-050 Konstantynów Łódzki, NIP: 6641189000, REGON: 386696413, e-mail address: info@latienebags.com, helpline: 661 814 800.
This Terms and Conditions document is continuously available on the website www.latienebags.com in a manner that allows its acquisition, reproduction, and recording at any time by printing or saving it to a storage device.
The Seller informs that the use of services provided electronically may involve a risk for every Internet user, consisting of the possibility of introducing malicious software into the Client’s IT system and the unauthorized acquisition or modification of their data. To minimize these risks, the Client should use appropriate technical measures, in particular antivirus software and a firewall.
II. Definitions
The terms used in these Terms and Conditions shall mean:
Business Days – days from Monday to Friday, excluding public holidays;
Client – a natural person with full legal capacity, a natural person conducting business activity, a legal person, or an organizational unit without legal personality that is granted legal capacity by specific provisions, who places an Order within the Online Store or uses other Services available therein;
Civil Code – the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
Account – a section of the Online Store assigned to a given Client, enabling the Client to perform certain actions within the Store;
Consumer – a Client who is a consumer as defined in Article 22[1] of the Civil Code;
Entrepreneur – a Client who is an entrepreneur as defined in Article 43[1] of the Civil Code;
Terms and Conditions – this document;
Goods – a product presented in the Online Store, with its description available alongside each presented item;
Sales Agreement – a sales contract for Goods within the meaning of the Civil Code, concluded between the Seller and the Client;
Services – services provided by the Seller to Clients electronically under the provisions of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
Consumer Rights Act – the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827);
Act on the Provision of Electronic Services – the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);
Order – a declaration of will by the Client aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
III. Rules for Using the Online Store
Using the Online Store is possible provided that the IT system used by the Client meets the following minimum technical requirements:

a computer or mobile device with Internet access,

access to an e-mail account,

an up-to-date web browser (Internet Explorer 11+, Firefox 28+, Chrome 32+, Opera 12.17+, or Safari 1.1+),
-
enabled Cookies and JavaScript in the browser.
Using the Online Store includes any activity of the Client leading to familiarization with the content of the Store.
The Client is obliged, in particular, to:

refrain from providing or transmitting unlawful content, including content promoting violence or violating personal rights or the rights of others,

use the Store in a manner that does not disrupt its operation,
-
refrain from sending or posting unsolicited commercial information (spam),
-
use the Store in a way that is not burdensome for other Clients or the Seller,
-
use all Store content solely for personal purposes,
-
comply with the applicable laws of the Republic of Poland, these Terms and Conditions, and general Internet use rules.
IV. Services
The Seller provides free Services via the Online Store 24/7, except for short maintenance breaks.
Creating an Account requires registration by completing and accepting a registration form available on the Store’s website. The agreement for maintaining an Account is concluded for an indefinite period and may be terminated at any time by requesting Account deletion.
The Client may subscribe to a Newsletter by providing a valid e-mail address or activating the appropriate checkbox in the registration or order form. The Client can unsubscribe at any time.
The Seller may organize occasional contests and promotions. Their terms will always be published on the Store’s website. Promotions cannot be combined unless stated otherwise.
In case of violation of these Terms, the Seller may terminate the Service Agreement after ineffective prior notice, with a 14-day notice period.
V. Procedure for Concluding a Sales Agreement
Information about Goods on the Store’s website constitutes an invitation to conclude an agreement as defined in Article 71 of the Civil Code.
All Goods available in the Store are brand new, free of defects, and legally introduced to the Polish market.
An active e-mail account is required to place an Order.
When placing an Order via the online form, the Client submits an offer to the Seller. The Sales Agreement is concluded when the Seller sends confirmation of the Order’s acceptance to the Client’s e-mail address.
The Sales Agreement is concluded in Polish and in accordance with these Terms and Conditions.
VI. Delivery
Goods are delivered to the address indicated by the Client when placing the Order.
The Client may choose one of the following delivery methods:

courier delivery,
-
InPost parcel lockers,
-
personal collection at the Seller’s location.
The Store specifies delivery times and shipping fees in the product descriptions.
If an Order includes Goods with different delivery times, the overall delivery period will correspond to the longest one.
The Seller provides a receipt or VAT invoice with the Order.
VII. Prices and Payment Methods
Prices are given in Polish zloty (PLN) and include VAT. Shipping costs are shown separately.
Available payment methods:

Bank transfer – the Order is processed after payment confirmation,

Cash on delivery,
-
Electronic payment,
-
Deferred payment through authorized external services.
If payment is not received within 5 days, the Seller may withdraw from the agreement under Article 491 of the Civil Code.
VIII. Right of Withdrawal
A Consumer may withdraw from the Agreement within 14 days without stating a reason. The withdrawal period begins on the day the Goods are delivered.
The Seller confirms receipt of the withdrawal declaration via e-mail.
The right of withdrawal does not apply to Goods made to the Consumer’s specifications or personalized items.
In the event of withdrawal, both parties must return what was exchanged within 14 days. The Client bears the direct cost of returning the Goods.
The Seller will refund payments using the same method used by the Consumer, unless agreed otherwise.
IX. Complaints for Goods
The Seller is obliged to deliver Goods free of defects.
Consumers may file complaints under Articles 556–576 of the Civil Code.

Complaints will be reviewed within 14 days.
X. Complaints Related to Electronic Services
Clients may report technical or service-related issues via e-mail or post. Complaints are reviewed within 14 days.
XI. Warranty
Some Goods may be covered by a manufacturer’s, importer’s, or Seller’s warranty. Details are included in the product description.
XII. Alternative Dispute Resolution
Consumers may use out-of-court complaint and redress procedures, including:

submitting disputes to a permanent consumer arbitration court,
-
initiating mediation with the regional Trade Inspection Authority,
-
seeking assistance from the Consumer Federation or Polish Consumer Association,
-
filing a complaint via the EU ODR platform at: http://ec.europa.eu/consumers/odr/.
XIII. Personal Data Protection
Clients’ personal data are collected and processed in accordance with applicable law and the Privacy Policy.
XIV. Final Provisions
All intellectual property rights to the Online Store, including its name, domain, design, and content, belong to the Seller.
Disputes involving Consumers will be settled by competent courts as defined by civil procedure law. Disputes with Entrepreneurs shall be settled by the court having jurisdiction over the Seller’s registered office.
For matters not covered by these Terms, the provisions of Polish law apply.
Any amendments to these Terms will be announced on the Store’s main page at least 14 days before taking effect. Clients with Accounts will be notified via e-mail. Refusal to accept the amended Terms results in termination of the Service Agreement.
